The Law Commission of England and Wales Provisionally Proposes Treating Software and AI Systems as Products Under the Consumer Protection Act
In a summary of its consultation paper on product liability, published on October 8, 2026, the Law Commission of England and Wales sets out provisional proposals to bring software and AI systems within the Consumer Protection Act 1987, and to stop a producer relying on one defense where it caused a product to become defective after supply.
